  • The Tamil Nadu Legislative Council (Repeal) Bill, 2012 was introduced in the Rajya Sabha on May 4, 2012 by the then Minister for Law and Justice, Mr. Salman Khurshid.
  • The Bill repeals the Tamil Nadu Legislative Council Act, 2010.
  • The Act was passed by Parliament to provide for the creation of a Legislative Council for the state of Tamil Nadu, in pursuance of a resolution passed by the Legislative Assembly, on April 12, 2010.
  • Further, the Act required that the President issue an order for appointing a date for the inclusion of the name of the state of Tamil Nadu into Article 168 (1) (a) of the Constitution, which includes names of states that have two houses, the Legislative Assembly and Legislative Council.
  • Prior to the constitution of the Legislative Council, the Legislative Assembly withdrew its decision to create a Legislative Council, by passing another resolution on June 7, 2011.
  • According to the Statement of Objects and Reasons, the President is yet to issue an order for a appointing a date for the inclusion of Tamil Nadu into the Constitution.
  • Therefore, after the repeal of the Act, by way of this Bill, there would be no need to amend Article 168 (1) (a) of the Constitution.
  • The Bill also proposes consequential amendments to The Representation of the People Act, 1950 and The Representation of the People Act, 1951.
