The Civil Damage for Nuclear Liability Bill, 2010 has been criticised on many grounds (Also click here), including (a) capping liability for the operator, (b) fixing a low cap on the amount of liability of the operator, and (c) making the operator solely liable.  We summarise the main principles of civil nuclear liability mentioned in IAEA's Handbook on Nuclear Law: Strict Liability of the Operator: The operator is held liable regardless of fault.  Those claiming compensation do not need to prove negligence or any other type of fault on the part of the operator.  The operator is liable merely by virtue of the fact that damage has been caused. Legal channeling of liability on the operator: "The operator of a nuclear installation is exclusively liable for nuclear damage. No other person may be held liable, and the operator cannot be held liable under other legal provisions (e.g. tort law)...This concept is a feature of nuclear liability law unmatched in other fields of law."  The reason for this has been quoted in the Handbook as:

"...Firstly, it is desirable to avoid difficult and lengthy questions of complicated legal cross-actions to establish in individual cases who is legally liable. Secondly, such channelling obviates the necessity for all those who might be associated with construction or operation of a nuclear installation other than the operator himself to take out insurance also, and thus allows a concentration of the insurance capacity available.”

Limiting the amount of liability: "Limitation of liability in amount is clearly an advantage for the operator.  Legislators feel that unlimited liability, or very high liability amounts, would discourage people from engaging in nuclear related activities. Operators should not be exposed to financial burdens that could entail immediate bankruptcy....Whatever figure is established by the legislator will seem to be arbitrary, but, in the event of a nuclear catastrophe, the State will inevitably step in and pay additional compensation. Civil law is not designed to cope with catastrophes; these require special measures." Limitation of liability in time: "In all legal systems there is a time limit for the submission of claims. In many States the normal time limit in general tort law is 30 years. Claims for compensation for nuclear damage must be submitted within 30 years in the event of personal injury and within 10 years in the event of other damage. The 30 year period in the event of personal injury is due to the fact that radiation damage may be latent for a long time; other damage should be evident within the 10 year period." Insurance coverage: "The nuclear liability conventions require that the operator maintain insurance or provide other financial security covering its liability for nuclear damage in such amount, of such type and in such terms as the Installation State specifies....This ensures that the liability amount of the operator is always covered by an equal amount of money. The congruence principle is to the advantage both of the victims of a nuclear incident and of the operator. The victims have the assurance that their claims are financially covered, and the operator has funds available for compensation and does not need to convert assets into cash.

17वीं लोकसभा के पहले अविश्वास प्रस्ताव पर आज चर्चा शुरू हुई। अविश्वास प्रस्ताव और विश्वास प्रस्ताव विश्वास मत होते हैं जिनका उपयोग सत्तासीन सरकार के लिए लोकसभा के समर्थन का परीक्षण या प्रदर्शन करने के लिए किया जाता है। संविधान के अनुच्छेद 75(3) में कहा गया है कि सरकार सामूहिक रूप से लोकसभा के प्रति उत्तरदायी है। इसका मतलब यह है कि सरकार को हमेशा लोकसभा के अधिकांश सदस्यों का समर्थन प्राप्त होना चाहिए। इस समर्थन की जांच के लिए विश्वास मतों यानी ट्रस्ट वोट्स का उपयोग किया जाता है। अगर अधिकांश सदस्य अविश्वास प्रस्ताव का समर्थन करते हैं या विश्वास प्रस्ताव को अस्वीकार कर देते हैं तो सरकार इस्तीफा दे देती है।

अब तक 28 अविश्वास प्रस्तावों (आज जिस पर चर्चा हो रही है, उसके सहित) और 11 विश्वास प्रस्तावों पर चर्चा हो चुकी है। पिछले कुछ वर्षों में ऐसे प्रस्तावों की संख्या कम हो गई है। 1960 के दशक के मध्य और 1970 के दशक के मध्य में अविश्वास प्रस्ताव अधिक देखे गए जबकि 1990 के दशक में विश्वास प्रस्ताव अधिक देखे गए।

आज जिस अविश्वास प्रस्ताव पर चर्चा हो रही है, वह 26 जुलाई 2023 को पेश किया गया था। अविश्वास प्रस्ताव कम से कम 50 सदस्यों के समर्थन से पेश किया जाता है। प्रस्ताव पर चर्चा के लिए समय आवंटित करने का अधिकार अध्यक्ष के पास है। प्रक्रिया के नियमों में कहा गया है कि प्रस्ताव पेश होने के 10 दिनों के भीतर चर्चा की जानी चाहिए। इस वर्ष अविश्वास प्रस्ताव पेश होने के 13 कैलेंडर दिनों बाद चर्चा हुई। 26 जुलाई को अविश्वास प्रस्ताव पेश होने के बाद से 12 बिल पेश किए गए हैं और 18 बिल लोकसभा ने पारित किए हैं। इससे पहले चार मौकों पर अविश्वास प्रस्ताव पर चर्चा, प्रस्ताव पेश होने के सात दिन बाद शुरू हुई थी। इन मौकों पर अविश्वास प्रस्ताव पर चर्चा शुरू होने से पहले कई बिल्स और अन्य महत्वपूर्ण मुद्दों पर बहस हुई।

अविश्वास प्रस्ताव (आज जिस प्रस्ताव पर चर्चा हो रही है, उसे छोड़कर) पर औसत तीन दिनों में 13 घंटे चर्चा हुई है। चार मौकों पर चर्चा 20 घंटे से अधिक समय तक चली है, सबसे हाल में 2003 में। आज के अविश्वास प्रस्ताव पर कार्य मंत्रणा समिति ने 12 घंटे की चर्चा का समय आवंटित किया था।

चर्चा के बाद प्रस्ताव को मतदान के लिए रखा जाता है। 27 में से 26 अविश्वास प्रस्तावों (आज जिस पर चर्चा हो रही है, उसे छोड़कर) पर मतदान हो चुका है और उन्हें खारिज कर दिया गया है। इसका मतलब यह है कि अविश्वास मत के बाद किसी भी सरकार को कभी इस्तीफा नहीं देना पड़ा है। एक अवसर पर, 1979 में मोरारजी देसाई सरकार के खिलाफ अविश्वास प्रस्ताव पर चर्चा अनिर्णायक रही। प्रस्ताव पर मतदान होने से पहले उन्होंने इस्तीफा दे दिया। सभी अविश्वास प्रस्तावों में से 50% (28 में से 14) पर 1965 और 1975 के बीच चर्चा की गई। इनमें से 12 इंदिरा गांधी के नेतृत्व वाली सरकारों के खिलाफ थे।

इसकी तुलना में विश्वास प्रस्तावों का इतिहास अधिक विविध है। चरण सिंह की सरकार में विश्वास प्रदर्शित करने के लिए 1979 में लाए गए पहले प्रस्ताव पर बिल्कुल भी चर्चा नहीं हुई। चर्चा होने से पहले ही प्रधानमंत्री ने इस्तीफा दे दिया। तब से लोकसभा में 11 विश्वास प्रस्तावों पर चर्चा हुई हैजिनमें से नौ 1990 के दशक में हुए थे। इस अवधि के दौरान कई गठबंधन सरकारें बनीं और प्रधानमंत्रियों ने विश्वास प्रस्तावों के माध्यम से अपना बहुमत साबित करने की कोशिश की। इन प्रस्तावों पर दो दिनों में औसतन 12 घंटे तक चर्चा हुई है।

लोकसभा में जिन 11 विश्वास प्रस्तावों पर चर्चा हुई, उनमें से सात स्वीकार कर लिए गए। तीन मामलों मेंसरकारों को इस्तीफा देना पड़ा क्योंकि वे यह साबित नहीं कर सकीं कि उन्हें बहुमत का समर्थन प्राप्त था। 1996 में एक मौके पर प्रस्ताव पर मतदान नहीं कराया गया। इस विश्वास प्रस्ताव पर 11 घंटे की चर्चा के बाद प्रधानमंत्री अटल बिहारी वाजपेयी ने सदन के पटल पर इस्तीफा देने के अपने इरादे की घोषणा की। उन्होंने अपने कार्यकाल के 16 दिन बाद इस्तीफा दे दिया।

1999 में वाजपेयी फिर से प्रधानमंत्री बने और उन्हें एक और विश्वास प्रस्ताव का सामना करना पड़ा। इस बार इस पर मतदान कराया गया। प्रस्ताव एक वोट के अंतर से गिर गया। लोकसभा के इतिहास में विश्वास मत पर यह सबसे करीबी नतीजा है। अगला निकटतम परिणाम तब था, जब 1993 में पी वी नरसिंह राव की सरकार के खिलाफ अविश्वास प्रस्ताव 14 वोटों से गिर गया था। ज्यादातर मामलों मेंपरिणाम बड़े अंतर से सरकार के पक्ष में रहे हैं।
