Bill Summary

The Factories (Jharkhand Amendment) Bill, 2023

  • The Factories (Jharkhand Amendment) Bill, 2023, was introduced in the Jharkhand Legislative Assembly on August 2, 2023.  It amends the Factories Act, 1948 in its application to Jharkhand.  The 1948 Act is an Act passed by Parliament, which regulates the safety, health, and welfare of factory workers.

  • Night shift for women workers: The Act imposes certain restrictions on employing women in factories.  These restrictions include that no woman will be required or allowed to work in any factory between 7:00 PM and 6:00 AM.  State governments may reduce the restricted hours, however, no state government may authorise women to work between 10:00 PM and 5:00 AM.  The Bill replaces this exception in its application to Jharkhand.  It provides that women workers may be allowed or required to work between 7:00 PM and 6:00 AM in any factory with adequate safety and security measures.
