• The Telangana Housing Board (Amendment) Bill, 2021 was introduced in Telangana Assembly on September 27, 2021.  It amends the Telangana Housing Board Act, 1956.   The Act provides for the formation of the Housing Board and the Board will take measures to deal the need of housing accommodation in the state.  The Bill removes the provision for certain nominated members.  It also removes the requirement for the transfer of surplus funds from the Board’s funds to the Consolidated Fund.  Key features of the Bill are:
  • Nominated members: The Act provides that the state government will nominate one member representing the cities of Hyderabad and Secunderabad to the Board.  The Bill removes this provision.
  • Management of Board’s funds: The Act states that the Board shall have its own fund.  It specifies that the surplus net revenue after meeting the expenditure of the Board shall be transferred to the Consolidated Fund of the State on a quarterly basis.  The Bill removes this provision.  Further, the omission will be deemed to have been in effect from April 1, 2002. 
  • The Bill adds that the fund will be deemed to be always vested in the state.  It further states that the fund will be operated by the Board based on the directions given by the state government.
  • Status of the Board: The Bill adds certain clarifications regarding the status of the Board.  These include: (i) the Board is and always be deemed to be an agent of the state and all income of the Board belongs to the state and (ii) the Board will enter or deemed to have entered into contracts as an agent of the state.
