The Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Ordinance, 2023

  • The Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Ordinance, 2023 was promulgated in March 2023.  The Ordinance amends the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Act, 1979.  The Act provides for compounding of certain offences and abatement of trials for certain offences under a total of seven Acts.  These include: (i) the Motor Vehicles Act, 1939, (ii) the Minimum Wages Act, 1948, (iii) the Police Act, 1861, and (iv) the Code of Criminal Procedure, 1973.  Compounding refers to the procedure where the two sides agree to stop legal proceedings, and settle the dispute.

  • Extension of date for abatement of trials: The Act abates trials for certain offences under the Code of Criminal Procedure, 1973 pending before a Magistrate from before December 31, 2016.  These comprise trials in relation to offence of: (i) likelihood of breaching peace in public or disturbing the public tranquillity, and (ii) attempting to conceal physical presence or identity with a view to committing a cognisable offence.  The Ordinance extends the period for abatement of trials in case of these offences from December 31, 2016 to December 31, 2021.
